SICK LEAVE / Medical Certificates and Reporting. 10.1 Sick leave benefits are sponsored by the Employer and will be granted with pay for the purpose of obtaining necessary medical or dental treatment or on account of injury, illness or disability to the extent hereinafter provided. (a) In the first year of employment with the Employer, the teacher shall be entitled to statutory sick leave. Should sick leave exceed the number of days of sick leave entitlement, any salary adjustment required shall be made on the last cheque issued to the teacher for the current school year. (b) During the second and subsequent years under contract, annual sick leave with full salary will be granted for the purpose of obtaining necessary medical or dental treatment, or because of accident, sickness or disability for ninety (90) calendar days. (c) A teacher who has more than one (1) year of service and has been absent due to medical disability shall, upon return to full-time duty, be entitled to an additional sick leave benefit of ninety (90) calendar days. (d) For the purpose of this Collective Agreement, an interrupted illness for the same illness shall be counted as one illness. 10.3 Before any payment is made under the foregoing provisions, a teacher may be required by the Employer to substantiate their illness as follows: (a) Either a statement, in a form approved by the Employer, signed by the teacher substantiating the illness or, (b) At the request of the Employer, a certificate from the teacher’s attending medical or dental practitioner where the absence is for a period of more than three (3) days. (c) Notwithstanding Article 10.3(b) above, where the Employer is concerned about the pattern and/or frequency of a teacher’s absences, they may notify the teacher in writing of the obligation to provide a medical certificate to support any further absences for the remainder of the school year. (d) At the request of the Employer or its designate, a certificate from a physician or dentist designated by the Employer attesting to the illness or disability claimed provided there is no cost to the teacher. (e) The Employer may request confirmation from the teacher’s physician that the teacher is following the physician’s recommended treatment plan. If there is a fee for the physician’s confirmation, the Employer shall reimburse the teacher following delivery of a receipt to the Employer. (a) Teachers shall be eligible for sick leave from the onset of illness or disability to the extent of sick leave credited to them but not beyond the date of eligibility for benefit under the Alberta School Employee Benefit Plan. (b) After ninety (90) continuous calendar days of illness or medical disability, no further salary shall be paid.

(c) Notwithstanding Article 10.3(bWhere a teacher has been absent for ten (10) aboveor more teaching days and prior to return to work, where a medical statement, if requested by the Employer is concerned about the pattern and/or frequency of a teacher’s absencesSuperintendent, they may notify that the teacher in writing is fit to return to work or a statement of the obligation restrictions to be accommodated. d) Where the absence extends for a period of one (1) month or greater, a further medical certificate, if requested by the School Jurisdiction, every thirty (30) days for the duration of the absence. e) When the School Jurisdiction requires a teacher to attend to a medical examination provided by a qualified medical or dental practitioner designated by the School Jurisdiction, all reasonable out-of-pocket expenses incurred by the teacher will be reimbursed by the School Jurisdiction. f) Costs of medical certificates, if requested by the School Jurisdiction after thirty (30) days of absence, will be paid for by the School Jurisdiction. 10.4.1 In the event there is an epidemic or public health issue, the School Jurisdiction may waive the requirement to provide a medical certificate as per clause 10.4(b). Notification will be provided to support any the Association if this occurs. 10.5 Where the School Jurisdiction requires further absences medical information under an independent medical examination (IME) or a more extensive medical certificate to be filled out, the teacher and the Coordinator of Teacher Welfare for the remainder of the school year. (d) At the request of the Employer or its designate, a certificate from a physician or dentist designated by the Employer attesting to the illness or disability claimed provided there is no cost to the teacher. (e) The Employer may request confirmation from the teacher’s physician that the teacher is following the physician’s recommended treatment plan. If there is a fee for the physician’s confirmation, the Employer shall reimburse the teacher following delivery of a receipt to the Employer. (a) Teachers Association shall be eligible for sick leave from the onset of illness or disability to the extent of sick leave credited to them but not beyond the date of eligibility for benefit under the Alberta School Employee Benefit Plannotified. (b) After ninety (90) continuous calendar days of illness or medical disability, no further salary shall be paid.

(b) 10.5 After ninety (90) continuous 90 calendar days of illness or continuous absence due to medical disability, no further salary or benefits will be paid except for the following circumstances: 10.5.1 a teacher in receipt of payment under extended disability insurance shall be paidentitled to the Board portion of insurance premiums; 10.5.2 a teacher who no longer qualifies for extended disability insurance and is unable to resume his or her duties due to medical disability shall be entitled to the Board portion of insurance premiums for a period of 90 calendar days following the termination of extended disability insurance payments. 10.6 A teacher who has been absent for the above reasons and returns to regular duties shall have the 90 calendar day sick leave entitlement reinstated. However, in instances where the teacher has been continuously absent for a period of 60 or more calendar days, reinstatement of the sick leave entitlement shall be made contingent on the teacher providing a medical certificate, signed by a medical practitioner, approved or selected by the Board, prior to the date of return, verifying that the teacher is able to return to work on a continuing basis. 10.7 In order to qualify for payment of sick leave: 10.7.1 when the sick leave is for a period of three (3) days or less, a teacher shall provide, on a form to be supplied by the Board, a declaration as to the reason for the absence under Article 10, or 10.7.2 when the sick leave is for a period in excess of three (3) consecutive teaching days, a teacher shall provide, upon the request of the Superintendent of Schools, a certificate signed by a medical practitioner indicating that the absence was necessitated by medical disability. 10.8 The Board shall be entitled to require of a teacher but at no cost to the teacher, a medical examination by a medical practitioner or dentist selected by the Board. Such an examination, where practical, will occur on an operational day. The Board shall ensure that the medical practitioner or dentist is requested to provide a copy of any resultant report to the teacher. 10.9 Teachers unable to carry on their duties on account of illness or any other cause shall give at least one (1) hour notice to Human Resources before school assembles so that substitute teachers may be obtained. Before returning to duty, the absentee teacher shall also notify Human Resources of such intended return. If returning for the morning session, the notification must be given at least one (1) hour before school opening, and for the afternoon session, two (2) hours before classes assemble. If a teacher fails to observe this requirement, the Superintendent of Schools may, after investigating the circumstances, charge the teacher one-half (½) day's rate of pay of a substitute teacher (as per clause 5.1) if one was provided.

Should the School Jurisdiction amend this form, the Association shall be notified and provided a copy of the amended form. 10.2.1 A teacher who is absent from school duties to obtain necessary medical or dental treatment, or because of accident or sickness for a period of three (d3) At consecutive teaching days or less shall be required to present to the principal a signed statement giving the reason for such absence immediately upon return to teaching duties. 10.2.2 In the case of any request of for prolonged sick leave with pay, the Employer or School Jurisdiction may require, at its designateexpense, a certificate from a physician medical or dentist dental practitioner designated by the Employer attesting School Jurisdiction. 10.2.3 The School Jurisdiction may require any teacher employed by it to undergo a medical examination by a physician named or approved by the School Jurisdiction. 10.2.4 When a teacher has been on sick leave and wishes to return to work, the teacher may be required by the School Jurisdiction to provide medical evidence, satisfactory to the illness or disability claimed provided there is no cost to the teacher. (e) The Employer may request confirmation from the teacher’s physician School Jurisdiction, stating that the teacher is following the physician’s recommended treatment plan. If there is fit to perform all regular duties on a fee for the physician’s confirmation, the Employer shall reimburse the teacher following delivery of a receipt to the Employercontinuous basis. (a) Teachers shall be eligible for sick leave from the onset of illness or disability to the extent of sick leave credited to them but not beyond the date of eligibility for benefit under the Alberta School Employee Benefit Plan. (c) A In accordance with the provision of the Education Act, a teacher who has more than one (1) in their first year of service with the Employer and whose contract commences after the beginning of a school year shall receive sick leave on a pro-rata basis as follows: b) a teacher in their first year of service with the Employer whose contract commences at the beginning of a school year shall have 20 sick leave days available effective the first day of the school year. c) a teacher with one or more years of service with the Employer shall have 90 calendar days of sick leave available effective the first day of the school year. 10.2 When any teacher has been continuously absent due to medical disability shallfor 90 calendar days, the ASEBP extended disability plan shall take effect and no remaining entitlements to salary or benefit premiums shall be paid. Prior to expiry of the qualifying period under the extended disability plan, a teacher absent due to sickness shall make application for extended disability benefits and upon expiry of the said qualifying period such teacher shall no longer be eligible to receive sick leave benefits. 10.3 Where a teacher has suffered an illness and/or has been paid under the provisions of the ASEBP, upon their return to full-time duty, they shall be entitled to an additional sick leave benefit of ninety (90) calendar days. (d) For benefits in accordance with the purpose of this Collective Agreement, an interrupted illness for the same illness shall be counted as one illness. 10.3 Before any payment is made under the foregoing provisions, a teacher may be required by the Employer to substantiate their illness as followsfollowing schedule: (a) Either a statement, in a form approved by the Employer, signed by In instances where the teacher substantiating the illness or, (b) At the request of the Employer, a certificate from the teacher’s attending medical or dental practitioner where the absence is has been continuously absent for a period of sixty (60) or more than three (3) calendar days. (c) Notwithstanding Article 10.3(b) above, where reinstatement of the sick leave entitlement will be made contingent upon the Employer is concerned about the pattern and/or frequency of receiving a teacher’s absences, they may notify the teacher in writing of the obligation to provide certificate signed by a medical certificate to support any further absences for the remainder of the school year. (d) At the request of the Employer or its designate, a certificate from a physician or dentist designated by the Employer attesting to the illness or disability claimed provided there is no cost to the teacher. (e) The Employer may request confirmation from the teacher’s physician practitioner verifying that the teacher is following able to return to work and assume all duties and responsibilities on a continuing basis. b) If the physician’s recommended treatment plan.
