Common use of Signed Instruments Clause in Contracts

Signed Instruments. Any action which may be taken and any power which may be exercised by the Holders at a meeting held as hereinbefore in this Article provided may also be taken and exercised by the Holders of not less than a majority of the principal amount of the outstanding Notes, or the applicable Series of Notes, by signed instrument and the expression “Extraordinary Resolution” when used in this Indenture shall include an instrument so signed. Notice of any Extraordinary Resolution passed in accordance with this Section 9.16 shall be given by the Trustee to the Holders of Notes within 30 days of the date on which such Extraordinary Resolution was passed.

Any action which may be taken and any power which may be exercised by the Holders Debentureholders at a meeting held as hereinbefore in this Article 10 provided may also be taken and exercised by the Holders of not less than a majority 66 2/3% of the principal amount of the outstanding Notes, or the applicable Series of Notes, Debentures by a signed instrument and the expression “"Extraordinary Resolution” " when used in this Indenture shall include an instrument so signed. Notice of any Extraordinary Resolution passed in accordance with this Section 9.16 section 10.15 shall be given by the Trustee to the Holders of Notes Debentureholders within 30 days of the date on which such Extraordinary Resolution was passed.
