Significant Force Majeure Event. (a) Within 30 days following the date on which the Concessionaire first became aware of any Force Majeure Event that is reasonably expected to be a Significant Force Majeure respond in 21 days, such failure by the Department shall not be deemed approval of the Right of Way Acquisition Plan. The Right of Way Acquisition Plan shall be updated as necessary during the life of the Route 495 HOT Lanes in Virginia Project.
