Common use of Simultaneous Adjustments Clause in Contracts

Simultaneous Adjustments. In the event that this Article 11 requires adjustments to the Conversion Rate under more than one of Sections 11.06, 11.07, 11.08(a) or 11.08(b), and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.08(a), second, the provisions of Section 11.08(b), third the provisions of Section 11.06 and, fourth, the provisions of Section 11.07.

Simultaneous Adjustments. In the event that If this Article 11 10 requires adjustments to the Conversion Rate under more than one of Sections 11.0610.06(4), 11.07, 11.08(a) 10.07 or 11.08(b)10.08, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.08(a)10.06, second, the provisions of Section 11.08(b), third the provisions of Section 11.06 10.08 and, fourththird, the provisions of Section 11.0710.07.

In the event that this Article 11 requires adjustments to the Conversion Rate under more than one of Sections 11.0611.7, 11.0711.8, 11.08(a11.9(a) or 11.08(b11.9(b), and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 11.08(a11.9(a), second, the provisions of Section 11.08(b11.9(b), third the provisions of Section 11.06 11.7 and, fourth, the provisions of Section 11.0711.8.
