Common use of Simultaneous Adjustments Clause in Contracts

Simultaneous Adjustments. In the event that this Article Thirteen requires adjustments to the conversion price or conversion rate under more than one of Sections 13.7(4), 13.8 or 13.9, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 13.7, second, the provisions of Section 13.9 and, third, the provisions of Section 13.8. ARTICLE FOURTEEN

In the event that this Article Thirteen Fifteen requires adjustments to the conversion price or conversion rate Conversion Rate under more than one of Sections 13.7(415.6(4), 13.8 15.7, 15.8 or 13.915.9, and the record dates for the distributions giving rise to such adjustments shall occur on the same date, then such adjustments shall be made by applying, first, the provisions of Section 13.715.6(4), second, the provisions of Section 13.9 and15.8, third, the provisions of Section 13.8. ARTICLE FOURTEEN15.7, and fourth, the provisions of Section 15.9.
