Site Availability. The Site Availability Service Levels for the Business VPN Small, and Business VPN Corporate for Locations in Regions A, B, C, D, and E are set forth Table 3 (Site Availability Service Levels for Regions A, B, C, D & E Locations) in Exhibit A to this Service Level Agreement so long as the Locations do not have Business VPN Lite Service. The Site Availability Service Level does not apply to Business VPN Small Off-Net. The actual Site Availability is calculated on a Monthly basis. If the actual Site Availability is less than the Site Availability Service Level, then Customer will be entitled to receive a credit against the Monthly Recurring Charge for the applicable Site Profile for the Location where the Outage occurred. The credit will be calculated as one thirtieth (1/30th) of the Monthly Recurring Charge for each full hour of Outage exceeding the Outage time allowed under the Site Availability Service Level, up to a cumulative maximum credit of 100% of Monthly Recurring Charge. All credits will be pro-rated on a per minute basis. Notwithstanding the foregoing, the Site Availability Service Level is subject to the following conditions:
(a) For Locations with Dual continuity solution, Customer must order from Orange the primary and secondary Access Circuits that are physically diverse (meaning that both Access Circuits take different routes so that a fault (e.g. power outage, cable cut, etc.) occurring on one circuit will not cause the other circuit to fail).
(b) For Locations with Dual continuity solution with FPD, if during the appliable Service Term the Access Provider(s) inform(s) Orange that Full Path Diversity is no longer in place at a Location, then the Site Availability Service Level for Dual with FPD (dual CE Routers) applicable to such Location will automatically and immediately change to the applicable Site Availability Service Level for Dual Without FPD (dual CE routers), as listed in Table 3 (Site Availability Service Levels for Regions A, B, C, D & E Locations) in in Exhibit A.
(c) For Locations with Air Backup continuity solution, Customer must test the Air Backup on a Monthly basis with the CSM.
(d) For any Location where there is only one CE Router, if the CE Router failure caused the Outage and the Location is outside Normal Service Condition, then the travel time needed by the Orange field engineer to get to the Location is excluded from the calculation of the total Outage time.

Site Availability. All or portions of the Site may be modified, updated, interrupted, suspended or discontinued at any time, at our sole discretion, without notice or liability. We may also remove any Content from the Site at our discretion, without notice or liability.
Site Availability. Subject to Article XVI, Operator will be responsible, at its sole cost and expense, for securing the rooftop, transmission tower, and SPRINT PROPRIETARY INFORMATION EXECUTION VERSION equipment room space necessary for the installation of the transmission facilities that operate on or in connection with any Spectrum. Operator will ensure that any lease or contractual agreement for rooftop, transmission tower, or equipment room space for use in connection with the Spectrum will be freely assignable by Operator to Sprint. Prior to entering into an agreement for the use of such facilities and space, Operator will consult with Sprint regarding the availability of facilities owned or leased by a Sprint Entity. In the development of the advanced high speed wireless data system in Region 1, Operator will procure tower space, backhaul and other network elements and services for use in such system from a Sprint Entity when commercially and competitively reasonable provided that any such Sprint Entity responds to any such inquiry by Operator in a timely manner.
Site Availability. 3.9.1 The District shall turn over the Site to the Design/Builder as described in the Notice to Proceed and as further described in EXHIBIT A – PROJECT MILESTONE SCHEDULE, at which time the Design/Builder shall be obligated to take control and responsibility. 3.9.2 Temporary parking facilities shall meet all applicable regulatory requirements applicable to design and construction. Design/Builder shall be responsible for all permits, design, and construction required including, but not limited to lighting, access, signage, handicap accessibility, and maintenance. At the end of the Project, all temporary parking and utilities shall be removed and those areas of the Project Site restored to its previous condition.

One thirtieth (1/30th) of the MRC for each full hour of Outage exceeding the Outage time allowed under the Site Availability Service Level, up to a cumulative maximum credit of 100% of MRC for the Location. All credits will be pro-rated on a per minute basis. Notwithstanding the foregoing, the Site Availability Service Level is subject to the following conditions:
(a) The Site Availability Service Levels apply only to Access Circuits ordered by Customer and provided by Orange as part of the Service. Accordingly, for Locations with dual Access Circuits, Customer must order and Orange must provide both Access Circuits as part of the Service.
(b) For any Location where there is only one Orange CE Router, if the Orange CE Router failure caused the Outage and the Location is outside Normal Service Condition, then the travel time needed by the Orange field engineer to get to the Location is excluded from the calculation of the total Outage time.
(c) For Locations that have dual Orange CE Routers or dual Access Circuits, the failure of one of the Orange CE Routers or one of the Access Circuits does not constitute an Outage.
(d) If during the appliable Service Term the Access Provider(s) cease(s) to provide Full Path Diversity at a Location, then the Site Availability Service Level applicable to such Location will be decreased automatically to the Dual Access Circuits with Dual Orange CE Routers (without FPD) Service Level.
