Common use of Site Repairs Clause in Contracts

Site Repairs. Z9.1 All Equipment and Plant belonging to the Employer to be repaired, modified and reconstructed shall be in the care and possession of the Contractor solely for the purposes of the Contract and shall be held by them as bailee and shall not be within the ownership or disposition of the Contractor. The Equipment and Plant shall be suitably marked as belonging to or held to the order of the Employer and shall be set aside from all other plant and equipment owned by or in the control of the Contractor. The Contractor shall ensure that it is not subject any liens, charges or counter claims to entitlement whether from the Contractor, its Subcontractors or any other party. Upon completion of any repair, modification or reconstruction the Contractor shall remain as bailee of the Equipment and Plant and shall ensure the safe and secure custody of the Equipment and Plant until delivered to or collected by the Employer.
