Installation of System. Subject to the terms and conditions of this Agreement, Customer hereby agrees with the assistance of OpenTech’s Setup Training and Customization (“STC”) Team to install the System on the Premises as follows:
a) Customer hereby represents, warrants and covenants that it (i) requested the System for Customer’s own use and not for the benefit of any other party, (ii) owns the Premises where the System is being installed or has the authority to authorize the installation of the System, and (iii) will comply with all laws, codes and regulations pertaining to the System installed and the Monitoring Services provided.
b) Customer will provide high speed internet access in accordance with the following specifications:
Installation of System. During the Installation Period, Generator shall:
Section 6.1.1 install, construct, service, maintain and test each System consistent with requirements of this Agreement, in a good and workmanlike manner, in accordance with all applicable laws and regulations, and within the time provided by the Project Schedule; and
Section 6.1. 2 obtain, the policies of insurance as set forth herein.
Installation of System. Seller, at Seller’s cost (subject to Customer’s obligations hereunder) will furnish, undertake, procure, and provide or cause to be performed, furnished, undertaken, procured and provided, all materials and work for the design, engineering, procurement, construction, installation, interconnection, testing, start-up and commissioning of the System and the Diesel Generator at the Site, diligently and in a good and workmanlike manner and in accordance with this Agreement, including the Scope of Work attached as Exhibit A, the System Plans approved by Customer, and in accordance with all applicable Laws and Prudent Industry Practices. Customer shall provide to Seller all information reasonably requested by Seller to safely, efficiently, and effectively install the System and the Diesel Generator and to operate the System (e.g., Property- specific electrical plan drawings and schedule of operations).
Installation of System. Operator agrees that it will construct and install the physical plant necessary to operate the System.
Installation of System. Seller shall design, construct and install the System and all related equipment, as described in Exhibit 2, on the Premises (including the design, engineering, permitting, installation, monitoring, operation and maintenance, interconnection, licensing, permitting, approvals, and paperwork processing for the System including all equipment necessary to meet local, state and national jurisdiction codes). Seller shall be responsible for clearing, grading and conforming to the Premises to meet all local drainage requirements. The solar photovoltaic panels are to be mounted [on south-facing, fixed tilt structures set at an angle for optimum summer performance], or [on structures in north-south rows utilizing a single-axis tracking system]. Vertical support elements for the photovoltaic panel racks are to be designed to meet wind/snow loadings and soil conditions identified for the sites. The System will be designed to meet all applicable local, state and national electric and fire codes as well as all interconnection requirements of the Utility. System performance will be governed by the appropriate provisions of Institute of Electrical and Electronics Engineers (IEEE) standard 1547-2018 and UL 1741. The System will maintain power factor of the delivered energy in the range of 95% lagging to 95% leading and meet or exceed IEEE 519-1992 total harmonic distortion requirements (THD<3%). The System will be equipped with bi-directional DNP3 communications capability and a Windows-based graphical user interface to allow Purchaser and the Utility the ability to control set points for low voltage ride through, specify operating VAR, limit ramp rates, and monitor input/output parameters including status of panel sub-arrays. System protective features shall include DC reverse polarity protection, ground fault monitoring, AC short circuit protection and carry all applicable UL ratings. The inverter(s) efficiency shall be a minimum of 97%. The System shall include instrumentation to measure and record wind speed/direction, ambient and panel temperatures, and solar irradiance at the site, and Seller shall provide Purchaser with access to the information therefrom. Seller’s work in connection with such installation shall be done in a good and xxxxxxx-like manner and in compliance with all applicable laws, codes and permits, such that under normal use and service conditions, the System will be free from defects in workmanship or defects in, or a breakdown of, materials or comp...
Installation of System. LICENSEE will install the System at or on the Facility in accordance with the Solar License Agreement (the “SLA”) attached hereto as Exhibit 3.
Installation of System. All products ordered under any resulting Master Agreement from this RFP shall be completely installed and tested for functionality by the Contractor. The Contractor shall provide all materials, equipment, parts and labor necessary for the installation of the ordered products, except for necessary network drops and/or telephone lines, and electrical outlets/connections. The installation shall be carried out by installers with the necessary training and experience. Installers shall have the appropriate tools and test equipment necessary to install the system correctly. Where signal strength measuring equipment is used, the equipment must be of a standard necessary to provide the required precision and accuracy to install and test the system. Contractor shall be required to comply with all applicable health and safety requirements. These will vary with the nature of the premises and may involve special installation equipment when working in hazardous areas. Electrical installation methods shall comply with current national and site regulations and the electrical installation shall be carried out by technicians who are qualified at the appropriate level.
Installation of System. The BES in hereby authorized to make preparations such as drilling holes, driving nails, making attachments or doing any other thing or things necessary or pertinent to the installation, and maintenance of the electrical protection apparatus and BES shall not be responsible for any condition created thereby doing the installation, maintenance or removal of the equipment, and further, BES shall not be responsible for the condition of premises upon the removal of the apparatus and the Subscriber warrants that it has full authority from the owner and / or any other person in control of the premises to permit the installation of the apparatus under all conditions herein above mentioned.
Installation of System. Customer shall install and operate the System at the Project Site identified in the Application for at least five (5) calendar years from the date that SoCalGas verifies the complete installation of the System. For purposes of this Agreement, complete installation of the System shall mean that the System has been installed, including, but not limited to, the System’s electrical, thermal and fuel connections, in accordance with industry practice for permanently installed equipment and that the System is securely attached to a permanent surface (i.e., foundation or other permanent equipment).
Installation of System. You authorize Wave to install or cause to be installed, the System. You further agree to allow Wave to remove any previously installed alarm or monitoring equipment, which in the opinion of Wave may interfere with the installation and/or maintenance of the System, whether such removal is required at the time of initial installation or at any time thereafter. After removal, Xxxx will return the previously installed alarm or monitoring equipment to you. Wave does not perform any wiring in connection with the installation of the System. If you have purchased equipment which requires wiring for use with the Service, you are responsible for installing the equipment or having it installed by qualified contractors. Errors or omissions in installation, including but not limited to failure to connect equipment, shall be called to the attention of Wave by you in writing within five (5) days after completion of the installation. Upon the expiration of the five (5) day period, the installation and the equipment provided shall be deemed accepted by you.
