Common use of Sole Discretion of Beneficiary Clause in Contracts

Sole Discretion of Beneficiary. Except as may otherwise be expressly ------------------------------ provided to the contrary, wherever pursuant to the Notes, this Deed of Trust, the Loan Agreement or any other document or instrument now or hereafter executed and delivered in connection therewith or otherwise with respect to the Loan secured hereby, Beneficiary or Trustee exercises any right given to Beneficiary or Trustee to consent or not consent, or to approve or disapprove, or any arrangement or term is to be satisfactory to Beneficiary or Trustee the decision of Beneficiary or Trustee to consent or not consent, or to approve or disapprove or to decide that arrangements or terms are satisfactory or not satisfactory, shall be in the sole and absolute discretion of Beneficiary or Trustee, as applicable, and shall be final and conclusive.
