Common use of Solicitation of Prospective Customers Clause in Contracts

Solicitation of Prospective Customers. Executive shall not during the Restricted Period, directly or indirectly, solicit the business of any person or entity that is a Prospective Customer (as defined below) or a customer or client of the Company. As used herein, “Prospective Customer” shall mean any person or entity whose business is being actively sought or in any way solicited, or known by Executive to be a person or entity whose business is the subject of possible solicitation by the Company. Executive expressly acknowledges that the length of time involved in soliciting and obtaining the business of new customers can be as long as two (2) years.
