Common use of Source of Payments; Budget and Appropriation Clause in Contracts

Source of Payments; Budget and Appropriation. The Lease Payments and Additional Payments shall be payable from any source of available funds of the Town, subject to the provisions of Section 6.2. The Town covenants to take such action as may be necessary to in- clude all Lease Payments and Additional Payments due hereunder in each of its budgets during the Term of the Lease Agreement and to make the necessary annual appropriations for all such Lease Payments and Additional Payments. The covenants on the part of the Town herein contained shall be deemed to be and shall be construed to be ministerial duties imposed by law and it shall be the duty of each and every public official of the Town to take such action and do such things as are required by law in the performance of the official duty of such official to enable the Town to carry out and perform the covenants and agreements in this Lease Agreement agreed to be carried out and performed by the Town. During the Term of the Lease Agreement, the Town shall furnish to the Authority and the Trustee, no later than ten days following the adoption of a budget for the current Fiscal Year, a certificate stat- ing that the Lease Payments and Additional Payments due in that Fiscal Year have been in- cluded in the budget approved by the Town Council for such Fiscal Year.

During the Term of the Lease AgreementAgree- ment, the Town City shall furnish to the Authority Agency and the Trustee, no later than ten thirty days following the adoption of a budget for the current Fiscal Year, a certificate stat- ing stating that the Lease Payments Pay- ments and Additional Payments due in that Fiscal Year have been in- cluded included in the budget approved ap- proved by the Town City Council for such Fiscal Year.

The Lease Payments and Additional Rental Payments shall be payable from any source of legally available funds of the TownDistrict, subject to the provisions of Article VI and Section 6.29.1. The Town District covenants to take such action as may be necessary to in- clude include all Lease Payments and Additional Payments coming due hereunder in each of its annual budgets during the Term of the this Lease Agreement and to make the necessary annual appropriations for all such Lease Payments. Annually, the District will furnish to the Lender a copy of the adopted budget for the current Fiscal Year, and a certificate of the District Representative stating that the Lease Payments have been included in the final budget of the District for the current Fiscal Year, to the full extent required hereunder. Each such budget and Additional Paymentscertificate shall be filed within 30 days after the adoption of such budget. The covenants on the part of the Town District herein contained shall be deemed to be and shall be construed to be ministerial duties imposed by law law, and it shall be the duty of each and every public official of the Town District to take such action and do such things as are required by law in the performance of the official duty of such official officials to enable the Town District to carry out and perform the covenants and agreements in this Lease Agreement agreed to be carried out and performed by the Town. To that end, the Council shall direct budgetary staff to include in each annual budget proposal to the Council an appropriation sufficient to pay Lease Payments and Additional Payments. The Town hereby expresses its present intent to appropriate Lease Payments and Additional Payments due under Section 4.7 hereof during the Term of the Lease Agreement.
