Common use of Spam or Unsolicited Promotions Clause in Contracts

Spam or Unsolicited Promotions. Any emails or any other messages that are circulated by Affiliate, directly or indirectly, including messages that are posted on social media networks, newsgroups, forums, chat boards and other types of online media and which: are directed at third parties who have not consented in writing in advance to receiving promotional messages from such Affiliate; contain false or misleading statements; do not truthfully identify the source or the originating IP Address from which it was sent; or do not provide the recipient with an option to easily be removed from receiving future mailings or promotions.

Any any emails or any other messages that are circulated by the Affiliate, directly or indirectly, including messages that are posted on social media networks, newsgroups, forums, chat boards boards, messengers’ groups and communities and other types of online media and which: : a. are directed at third parties who have not consented in writing in advance to receiving promotional messages from such Affiliate; ; b. contain false or misleading statements; statements (false advertising, etc.); c. do not truthfully clearly identify the source (sender) or the originating IP Address address from which it was sent; or or d. do not provide the recipient with an option to easily be removed opt out from receiving future mailings or promotionspromotions of the same nature.
