Common use of Spare and Replacement Parts Clause in Contracts

Spare and Replacement Parts. During the five (5) year period after Buyer’s acceptance of the Equipment under this Agreement (or such shorter or longer period as may be specified in the purchase order), Seller shall maintain, at its expense, the ability to and shall sell spare and replacement parts to Buyer to allow Buyer to continue to maintain and operate the Equipment. Unless otherwise agreed to by Buyer, the prices during this period shall be the prices (if any) specified for such spare and replacement parts in the purchase order for the Equipment, or, if no such prices are specified, the then- current prices generally charged by Seller; provided that such prices shall not be higher than those extended to any other customer for the same or similar spare and replacement parts in similar quantities.
