Installation, Maintenance, Testing and Repair. Unless otherwise agreed in writing by the Parties, to the extent required by Applicable Law, Interconnection provided by a Party shall be equal in quality to that provided by such Party to itself, any subsidiary, affiliates or third party. If either Party is unable to fulfill its obligations under this Section 14.2, it shall notify the other Party of its inability to do so and will negotiate alternative intervals in good faith. The Parties agree that to the extent required by Applicable Law, the standards to be used by a Party for isolating and clearing any disconnections and/or other outages or troubles shall be at parity with standards used by such Party with respect to itself, any subsidiary, affiliate or third party.

Installation, Maintenance, Testing and Repair. The intervals for installations, maintenance, joint testing, and repair of its facilities and services associated with or used in conjunction with Interconnection will be determined in accordance with the requirements of Section 3.8.

If Charges for a Service are provided for in this Agreement, such Charges shall apply.

A maintenance service charge applies whenever either Party requests the dispatch of the other Party's personnel for the purpose of performing maintenance activity on the interconnection trunks, and any of the following conditions exist: (a) no trouble is found in the interconnection trunks; (b) the trouble condition results from equipment, facilities or systems not provided by the Party whose personnel were dispatched; or (c) trouble clearance did not otherwise require a dispatch, and upon dispatch requested for repair verification, the interconnection trunk does not exceed maintenance limits. 9.2.1 If a maintenance service charge has been applied and trouble is subsequently found in the facilities of the Party whose personnel were dispatched, the charge will be canceled. 9.2.2 Billing for maintenance service by either Party is based on each half-hour or fraction thereof expended to perform the work requested. The time worked is categorized and billed at one of the following three rates: (1) basic time; (2) overtime; or (3) premium time as follows per half hour or fraction thereof: Basic Time per technician normally scheduled working hours $32.00 Overtime per technician outside of normally scheduled working Hours on a scheduled work day $48.00 Premium Time per technician outside of scheduled work day $64.00 A call out of a Party’s employee at a time not within the employee’s scheduled work period is subject to a minimum charge of two (2) hours.

Installation, Maintenance, Testing and Repair. Unless otherwise agreed to by the Parties, direct Interconnection shall be equal in quality to that provided by each of the Parties to any subsidiary, affiliate, or third party. For purposes of this Agreement, “equal in quality” means the same or equivalent interface specifications, provisioning, installation, maintenance, testing and repair intervals for the same or equivalent services under like circumstances. If either Party is unable to fulfill its obligations under this subsection 10.2, it shall notify the other Party of its inability to do so and will negotiate alternative intervals in good faith. The Parties agree that the standards to be used by each Party for isolating and clearing any disconnections and/or other direct or indirect Interconnection outages or troubles shall be no less favorable than those applicable to comparable arrangements, facilities, or services being provided by such Party to any other carrier whose network is connected to that of the Providing Party.

Installation, Maintenance, Testing and Repair. BA’s standard intervals for Feature Group D Switched Exchange Access Services will be used for Interconnection. ETC shall meet the same intervals for comparable installations, maintenance, joint testing, and repair of its facilities and services associated with or used in conjunction with Interconnection or shall notify BA of its inability to do so and will negotiate such intervals in good faith. The Parties agree that the standards to be used by each Party for isolating and clearing any disconnections and/or other outages or troubles shall be no less favorable than those applicable to comparable arrangements, facilities, or services being provided by such Party to any other carrier whose network is connected to that of the providing Party.
