Special Rule for Police Officers. An employee in the rank of Police Officer who is eligible to return to work following a leave of absence granted under this Section 25.03, shall have the right to return to work as a Police Officer regardless of whether a vacancy exists at the time they are ready to return to work, except when there is no vacancy due to a reduction in the number of budgeted “full time employees” in the rank of Police Officer that occurred while the employee was on a leave of absence. In that event, the employee may, at the time they are eligible to return to work, displace an employee in the rank of Police Officer with lesser seniority and the employee with the least seniority may be laid off subject to the provisions of Article 21.
