Common use of Specific Enrollee Rights and Protections Clause in Contracts

Specific Enrollee Rights and Protections. (A) The Contractor shall include all of the following Enrollee rights and protections in its member handbook, and in any other written Patient Rights statement: (1) the right to receive information about Contractor’s PMHP; (2) the right to be treated with respect and with due consideration for his or her dignity and privacy; (3) the right to receive information on available treatment options and alternatives, presented in a manner appropriate to the Enrollee’s condition and ability to understand; (4) the right to participate in treatment decisions regarding his or her health care, including the right to refuse treatment; (5) the right to be free from any form of restraint or seclusion used as a means of coercion, discipline, convenience, or retaliation, as specified in other Federal regulations on the use of restraints and seclusion; (6) if the privacy rule, as set forth in 45 CFR parts 160 and 164 subparts A and E, applies, the right to request and receive a copy of his or her medical records, and to request that they be amended or corrected, as specified in 45 CFR 164.524 and 45 CFR 164.526; (7) the right to be furnished health care services in accordance with access and quality standards; and (8) the right to be free to exercise all rights and that by exercising those rights, the Enrollee shall not be adversely treated by the Department, the Contractor, and its Participating Providers.

(A) The Contractor shall include all of the following Enrollee rights and protections in its member Enrollee handbook, and in any other written Patient Rights patient rights statement: (1) the right to receive information about Contractor’s PMHP; (2) the right to be treated with respect and with due consideration for his or her the Enrollee’s dignity and privacy; (3) the right to receive information on available treatment options and alternatives, presented in a manner appropriate to the Enrollee’s condition and ability to understand; (4) the right to participate in treatment decisions regarding his or her the Enrollee’s health care, including the right to refuse treatment; (5) the right to be free from any form of restraint or seclusion used as a means of coercion, discipline, convenience, or retaliation, as specified in other Federal federal regulations on the use of restraints and seclusion; (6) if the privacy rule, as set forth in 45 CFR parts 160 and 164 subparts A and E, applies, the right to request and receive a copy of his or her the Enrollee’s medical records, and to request that they be amended or corrected, as specified in 45 CFR 164.524 and 45 CFR 164.526; (7) the right to be furnished health care services in accordance with access and quality standards; and (8) the right to be free to exercise all rights and that by exercising those rights, the Enrollee shall not be treated adversely treated by the Department, the Contractor, and its Participating Network Providers, or the Department.
