Common use of Spill Conditions Clause in Contracts

Spill Conditions. For any day that the Federal System is in a Spill Condition, no credit is given for negative deviations (actual energy delivered is less than scheduled) for any period of that day. If the energy index is negative in any hour that the Federal System is in a Spill Condition: (1) For negative deviations (energy taken is less than the scheduled energy) within Band 1, no credit will be given. (2) For negative deviations (energy taken is less than the scheduled energy) within Band 2, the charge is the energy index for that hour. (3) For negative deviations (energy taken is less than the scheduled energy) within Band 3, the charge is the energy index for that hour.
