Common use of Standards of Care and Delegation of Duties Clause in Contracts

Standards of Care and Delegation of Duties. (a) The obligation of Servicer to perform its duties under this Agreement, including any duty to obtain or verify information, will be satisfied so long as Servicer acts in a manner consistent, with Accepted Servicing Practices. Servicer shall not be responsible for the form, substance, validity, perfection, priority, effectiveness or enforceability of any documents in the Servicing File on the Transfer Date or on the date that it obtains such documents from the Current Servicer.
