STATE OF RHODE ISLAND'S COVENANT NOT TO SUE. 9.1. Subject to the Reservation of Rights in Section 10 of this Agreement and upon the Department's issuance of the LOC, the State of Rhode Island and the Department covenant not to sue or take any other civil or administrative action against Settling Respondent for any and all civil liability or injunctive relief or reimbursement of response costs with respect to Existing Contamination.
