Stated Purpose for Which BA May Use or Disclose PHI. The Parties hereby agree that except as otherwise limited in this Addendum, BA shall be permitted to use or disclose PHI provided or made available from Covered Entity to perform any function, activity or service for, or on behalf of, Covered Entity as specified in this Addendum, provided that such use or disclosure would not violate the HIPAA Regulations if done by Covered Entity.

The Parties hereby agree that that, except as otherwise limited provided in this Addendum, BA shall be permitted to only use or disclose PHI provided or made available from Covered Entity to perform any functionservices to or for FTS or its customers, activity or service for, or on behalf of, Covered Entity as specified in this Addendum, provided that such use or disclosure would not violate accordance with HIPAA and the HIPAA Regulations if done by Covered EntityRegulations.

The Parties hereby agree that that, except as otherwise limited provided in the Agreement or this Addendum, BA shall be permitted to use or disclose PHI provided solely for the purpose of performing services to or made available from Covered Entity to perform any functionfor EMSI or its customers, activity or service for, or on behalf of, Covered Entity as specified in this Addendum, provided that such use or disclosure would not violate accordance with the applicable HIPAA Regulations if done by Covered Entityand HITECH Regulations.
