Statement by Xxxxxx. A statement in writing signed by a director, secretary, or officer of the Lender whose title includes the word ‘manager’ stating the amount due or owing by the Borrower to the Lender under this Agreement as at any date or dates set out in that statement will be prima facie evidence of amount due or owing.
Statement by Xxxxxx. A certificate signed by the Manager Acting Manager or any other officer of the Lender as to the monies or liabilities for the time being due or owing to or incurred by the Lender on account of the Borrower and/or the Assignor shall be conclusive evidence that the balance or amount thereby appearing is due or owing by the Borrower and/or the Assignor for all purposes whatsoever including for purposes of any legal proceedings.
Statement by Xxxxxx. Upon her execution of this Agreement, Xxxxxx will publish on her Twitter homepage or timeline [Twitter handle, unREDACKted (@JesselynRadack)], the following statement: “Since April 2018, I have been involved in litigation with Xxxxxx Xxxxxxxxxx. We have amicably resolved our differences. As part of the settlement, I retract and withdraw every allegation and statement I have ever made about Xx. Xxxxxxxxxx” (the “Xxxxxx Statement”). For a period of six months from the date of publication of the Xxxxxx Statement, Xxxxxx will not delete the Xxxxxx Statement from her Twitter feed or mute, protect or hide the Xxxxxx Statement in any way.
