Common use of Stay Pending Court Approval Clause in Contracts

Stay Pending Court Approval. Class Counsel and NAPG’s Counsel agree to stay all proceedings, other than those proceedings necessary to carry out or enforce the terms and conditions of the Settlement, until the Effective Date of the Settlement has occurred. If, despite the Parties’ best efforts, this Agreement should fail to become effective, the Parties will return to their prior positions in the Actions, in accordance with Section III of this Agreement. The Parties also agree to use their best efforts to seek the stay and dismissal of, and to oppose entry of any interim or final relief in favor of any Class Member in, any other proceedings against any of the Released Parties which challenges the Settlement or otherwise asserts or involves, directly or indirectly, a Released Claim.
