We will not be liable for mere clerical or inadvertent errors or a reasonable mistake of judgment if we pay the check over a stop payment request. In no event will we be liable if we pay the check or ACH on the same day we receive your stop payment request. If we pay a check or ACH over a valid stop payment request and re-credit your account for the amount of the check or ACH, you agree to transfer to us all of your rights against the payee of the check or ACH or person holding your check. You also agree to assist us in any suit or action we may take against the payee or holder of the check. We will not honor stop payments on cashier’s checks or other bank official checks. You may not place a stop payment on a check or ACH that has already been paid or otherwise accepted by us. An oral stop payment request must be confirmed in writing within 14 calendar days; otherwise it will expire. A stop payment request on a check will be valid for 180 days, but you may renew it before the 180 days expires. When the 180 days expires, we do not have to notify you before we pay the check. If you request a stop payment, you agree to pay our stop payment fee and to reimburse us for all costs and expenses we incur, including our attorneys’ fees, because of our refusal to pay the check (See the Retail Banking Fee Schedule). Stop Payment Requests. CorpLink allows you to: (1) place a Unless otherwise specified in any applicable Service Agreement, any stop payment order request which Customer wishes to place on a check drawn on an account that is the subject of up this Service or is otherwise related to six (6) months this Service shall be placed in duration; (2) cancel an existing accordance with the Bank's normal stop payment order; or procedures and provisions for other accounts in effect at that time. Any Stop Payment Request for ACH debits, paper drafts, P2P, Paypal, or other forms of electronic payments offered by the Bank must be placed at a Bank branch office location. If Customer has elected to issue stop payment placed orders via Business Online, the following provisions shall apply:
1. You have requested us to provide Stop Payment Services under Business Online to enable you to electronically issue stop payment entries (“Stop Payment Request”). You hereby agree to use the Stop Payment Services according to the instructions set forth in this Section H.
2. You may only submit Stop Payment Requests for checks that have not yet posted to the Account. Thus, prior to submitting Stop Payment Requests, you must first verify that the checks have not posted to the Account.
3. You understand and agree that Stop Payment Requests will not take effect unless you provide all the information requested by the Stop Payment screens and provide such information exactly as it appears on the CorpLink shall automatically expire at check, including, but not limited to, the time designated by account number, check number, amount, payee and date. You acknowledge that the computer programs used to provide the Stop Payment Services require exact information regarding the check and even minor errors in providing the exact information requested may prevent payment from being stopped. For example, if you – not to exceed six (6) months from date give us the wrong amount of the placement of check and the information is only wrong by one cent (.01) or if the check number you provide is only wrong by one digit, we will not be able to stop payment order by you.
A. You agree that any stop Bank is not liable to you for payment placed on of any check issued over a Stop Payment Request if you do not provide the exact information regarding the check.
4. Stop Payment Requests that we receive prior to 9:00 a.m. C.S.T. on your accounts designated a particular Business Day, will be effective on that Business Day. Conversely, Stop Payment Requests that we receive after that cut-off time will take effect on the Enrollment Form may next Business Day. However, you agree that we may stop payment according to an expired Stop Payment Request without incurring any liability to you. You further understand and agree that you, and not us, have written the obligation to monitor your Stop Payment Requests and that we will not provide you with any notice of the expiration dates of any Stop Payment Request and/or the need to renew any such requests.
6. You understand and agree that we will accept a Stop Payment Request and use reasonable procedures to locate and stop payment on the check. However, in consideration of our acceptance of the Stop Payment Request, you expressly agree to hold us harmless from any direct or indirect damages if we pay the check (non-electronicallyi) on your Bank accountsthe day we receive the Stop Payment Request, or (ii) by reason of oversight or inadvertence. To Furthermore, you hereby agree that we will not be effective, this type of stop-payment request must precisely identify the account number, name of the payee, liable to you for any direct or indirect damages if other checks drawn by you are returned NSF because we pay the check numberunder the circumstances noted in (i) or ii) herein. You further agree to indemnify us against all expenses and costs that might incur by reason of stopping payment on a check pursuant to a Stop Payment Request, the amount, the date of the check, and the reason for stop payment. Stop Payment Requests. CorpLink eCom allows you to: (1) place a stop payment order request of up to six (6) months in duration; (2) cancel an existing stop payment order; or (3) determine the paid status of a check. Any stop payment placed on the CorpLink eCom system shall automatically expire at the time designated by you – not to exceed six (6) months from date of the placement of the stop payment order by you.
A. You agree to indemnify Adirondack Bank against any loss for the amount of said check and all expenses, costs and consequential damages, if any, incurred by Adirondack Bank because of refusing payment pursuant to your stop payment order. You agree not to hold Adirondack Bank liable on account of payment contrary to your stop payment order if same occurs through inadvertence, accident or oversight, or if by reason of such payment other items drawn by the undersigned are returned insufficient. You agree that any stop payment placed on any check issued on your accounts designated on the Enrollment Form may be relied upon by Adirondack Bank to have been placed by an agent of you duly authorized to place the stop payment, and Adirondack Bank shall have no duty or obligation to verify either the authenticity of the stop payment order request or the authority of the person placing it.
B. Stopping the payment of a check is different from the cancellation of a xxxx payment. Once the xxxx payment has been debited from your account, you CANNOT cancel or stop a xxxx paymentpayment which has been paid electronically.
C. You may initiate stop-stop payment requests online via CorpLink eCom only for paper checks you have written (non-non- electronically) on your Adirondack Bank accountsaccounts (not ePay xxxx xxxxx paper drafts.) Online stop payment requests are processed on the business day following the date the stop payment has been requested online. To be effective, this type of stop-stop payment request must precisely identify the account number, name of the payee, the check number, the amount, the date of the check, and the reason for stop payment. Adirondack Bank shall have no responsibility to determine the accuracy of such information. Adirondack Bank shall provide you notice of the actual stop payment of a check by making such information accessible to you online via the eCom system.
D. If you make your stop-stop payment request online or by telephone, we may also require you to put your request in the form of a paper writing and get it to us within 14 days after you call. You will incur stop-stop payment charges as disclosed in the current fee schedule for the applicable account. Stop payment charges for eCom xxxx payment paper drafts will be assessed in addition to the stop payment charges for the applicable account.

If you make your stop-stop payment request online or by telephonebytelephone, we may also require you to put your request in the form of a paper writing written notification and get forward it to us within 14 days after days. We will not be liable for paying a check over a stop payment request if the request is incomplete or incorrect, or if a written notification is required but not provided. You agree to access the appropriate account history (such as prior account statements) and determine whether the check you callwant stopped has or has not already been paid. You will incur stop-stop payment charges as disclosed in the current fee schedule Consumer Service Fee Schedule for the applicable account. This request/notice must be received prior to any applicable Cutoff Hour and the Bank musthave a reasonable time to act on the request/notice prior to the Cutoff Hour. In the case of a pre-authorized ACH debit, you understand that the originator has the capability to changethe amount of the debit and that the Bank may not be able to stop any ACH debit other than the one conforming EXACTLY to the description you have given us on the form. If the item is an ACH debit, this request must be received bythe Bank at least three (3) Business Days before the scheduled payment date. The above requests/notices will not be effective if the Bank has already cashed the check or is already committed to honor or paythe item under applicable laws, regulations, or rules governing checks or ACH items. Stop payment requests are valid for six (6) months whether written, oral, or electronic. After that time, the check may be paid and charged to your account unless you renew the stop payment request in writingfor an additional fee. This request/notice will be cancelled if the account is closed or transferred. The request/notice is made subject to the terms of the Bank's deposit agreements in effect. You agree to indemnify, defend, and hold us harmless from all actions, claims, and damages related to, or arising from, our action in stopping payment on any check or ACH debit pursuant to your stop payment request.
