Common use of Subcontracting the Work Clause in Contracts

Subcontracting the Work. All Work shall be performed under written subcontracts or other appropriate agreements awarded by Contractor in accordance with the terms of this Agreement. Prior to entering into any subcontract, or permitting the letting of any subcontract, sub-subcontract or other contract or purchase orders containing a contingent payment clause, Contractor shall have furnished or caused to furnished to each such Subcontractor, sub- subcontractor and supplier of every tier a completed form of the Owner’s Confirmation of Funding (Exhibit 5), executed by Owner, to inform all such Subcontractors, sub- subcontractors and suppliers of every tier of the Construction Cost Limitation for the Project.
