Submission to Commissioner. Within ten (10) days of the issuance of the President’s decision at Step 3, the MTFA may notify the Commissioner of Higher Education of the union’s intent to advance the grievance to arbitration. Only the alleged violations of the collective bargaining agreement identified in the original grievance may be considered in arbitration. Upon mutual agreement, the parties may use grievance mediation prior to, or in lieu of, arbitration.
