Common use of Submission to Mediation Clause in Contracts

Submission to Mediation. If the matters raised in a Notice provided pursuant to Section VII.A are not resolved within forty-five (45) days of the initial meet and confer required by Section VII.C, either Party may submit the unresolved matters to nonbinding mediation before a mutually agreed upon mediator affiliated with Judicial Arbitration & Mediation Services (“JAMS”), or such other mediator as the Parties may jointly designate.
