Subordination of Lessor’s Lien. Lessor does hereby agree not to foreclose any liens or claims of lien against Lessee, the Leased Property, the Permitted Capital Improvements and all other trade fixtures and equipment of Lessee located on or in the Leased Property created pursuant to Oregon Revised Statutes Section 87.162 until such time as Lessor shall have afforded any Leasehold Mortgagee the opportunities to cure as set forth in this Article XX and neither Lessee nor such Leasehold Mortgagee has cured the same within the time limits afforded herein.
Subordination of Lessor’s Lien. Lessor agrees to subordinate, pursuant to the Lessor’s Subordination and Consent, any statutory or common law landlord’s lien of Lessor in the Personal Property, if any, to any lien or security interest that Lessee Lender may have against or in the Personal Property. Lessor agrees to execute and Lessee shall execute and cause Lessee Lender to execute such documents as Lessor, Lessee or Lessee Lender may reasonably require to evidence such subordination (the “Lessor’s Subordination and Consent”) provided that the form and substance of any such subordination is reasonably satisfactory to Lessor and Lessee promptly reimburses Lessor for all reasonable out-of-pocket costs and expenses incurred by Lessor in connection with such subordination, including, without limitation, reasonable attorneys’ fees.
Subordination of Lessor’s Lien. Upon written request from Xxxxxx, Xxxxxx agrees to reasonably subordinate its statutory and contractual landlord’s liens on the Improvements or Xxxxxx’s personal property and trade fixtures to the lien of a lender providing financing to the Lessee, consistent with the terms of this Lease.
