Common use of Subordination to Bond Resolution Clause in Contracts

Subordination to Bond Resolution. This Lease and all rights granted to Tenant hereunder are expressly subordinated and subject to the lien and provisions of the pledge, transfer, hypothecation or assignment made by County in the Bond Resolution, and County and Tenant agree that to the extent permitted by authorizing legislation, the holders of the bonds or their designated representatives may exercise any and all rights of County hereunder to the extent such possession, enjoyment and exercise are necessary to insure compliance by Tenant and County with the terms and provisions of this Lease and Bond Resolution.

This Lease Agreement and all rights granted to Tenant Operator hereunder are expressly subordinated and subject to the lien and provisions of the pledge, transfer, hypothecation or assignment made by County in the Bond Resolution, and County and Tenant Operator agree that to the extent permitted by authorizing legislation, the holders of the bonds Bonds or their designated representatives may shall exercise any and all rights of County hereunder to the extent such possession, enjoyment and exercise are necessary to insure ensure compliance by Tenant Operator and County with the terms and provisions of this Lease Agreement and Bond Resolution.
