Common use of Subrogation of Warranties Clause in Contracts

Subrogation of Warranties. To the extent transferrable, Assignee shall be and is hereby subrogated to all representations, covenants and warranties of title by parties (other than Assignor’s Affiliates) heretofore given or made to Assignor or its predecessors in title with respect and to the extent applicable to the Leasehold and Mineral Interests. To the extent provided in the preceding sentence, Assignor hereby grants and transfers to Assignee, its successors and assigns, to the extent so transferrable and permitted by applicable Laws, the benefit of and the right to enforce all representations, warranties and covenants, if any, which Assignor is entitled to enforce with respect to the Leasehold and Mineral Interests.
