If the Owner determines that the initial punch list indicates that the Project is not substantially complete, the initial punch list will review the list of items and schedule the requested inspection, or inform be returned to the Contractor in writing with written comments. (1) If the A/E reasonably determines that the initial punch list prepared by the Contractor substantially understates the amount of the Work remaining to be completed and the Project is not substantially complete, ODRthe A/E shall report this promptly to the Owner, and upon concurrence of the Owner, the Contractor will be assessed the costs of the inspection and other Owner representatives as determined punch list preparation incurred by the A/E and the Owner, will jointly attend the Substantial Completion Inspection, which shall be conducted by the ODR or their delegate. If the ODR determines that . Such warranty documents shall state the length of the warranty, which must comply with the Contract Documents. (4) The Certificate of Substantial Completion shall be submitted by the A/E will provide with this certificate a list of punchlist items (the Pre-Final Punchlist) for completion prior to final inspection. This list may include items in addition to those on the Contractor's punchlist, which the inspection team deems necessary to correct or complete prior to Final Inspection. If the Owner occupies and Contractor for their written acceptance of responsibilities assigned to them in such Certificate. The failure to include any items on this list does not alter the responsibility of Contractor to complete all Work in accordance with the Contract Documents. If the Owner occupies the facility Project upon determination of Substantial Completion, the Contractor shall complete all corrective Work at the convenience of the Owner, without disruption to Owner’s use of the facility Project for its intended purposes.its

Substantial Completion Inspection. When Subject to the Contractor considers provisions of UGC, Subsection 12.1.1, no later than the entire Work or part thereof Substantially Complete, it shall notify the ODR in writing that the Work will be ready for Substantial Completion Inspection on Deadline, A/E shall conduct a specific date. The Contractor shall include with this notice Substantial Completion Inspection of the Contractor’s Punchlist Work, while accompanied by the TFC Project Manager, to indicate that it has previously inspected all determine whether said portion of the Work associated with has achieved Substantial Completion. 2.1.6.5.1. Delivery of these items is a prerequisite for requesting the Substantial Completion Inspection. 12.1.1.2 On the date requested by Contractor, or as mutually agreed upon pending the status of the open items list, causes outside the A/E’s direct control (such as, ODRContractor’s errors in reporting readiness of the Work for Inspection; Contractor prematurely requesting substantial completion inspection; significant deficiencies in the Work unexcused delays in the Work; untested or improper performance of systems; or similar failures performed by Contractor or its agents), such service shall constitute an Additional Service. 2.1.6.5.2. In the Contractor event A/E and other Owner representatives TFC conclude that the Work, or a discrete and identified phase thereof, has been performed or completed in accordance with the Construction Documents so as to be determined to be substantially complete, TFC shall promptly issue an appropriate Certificate of Substantial Completion as to the completed Work, as provided in UGC, Paragraph 12.1.1.2, and A/E shall promptly take all such steps as are required by TDLR, as TFC’s authorized agent, to ensure the Project is completed in compliance with applicable requirements of TDLR including, but not limited to, obtaining a passing inspection by the OwnerA/E’s Registered Accessibility Specialist. 2.1.6.5.2.1. Any provision in the foregoing to the contrary notwithstanding, will jointly attend A/E shall not recommend the Substantial Completion Inspection, which shall be conducted by the ODR or their delegate. If the ODR determines that the Work is Substantially Complete, the ODR will issue issuance of a Certificate of Substantial Completion if, in its reasonable opinion, A/E determines that any of the items to be signed by contained in the A/EPost-Substantial Completion Inspection Punchlist cannot or, Owner and Contractorin all reasonable likelihood will not be, establishing satisfactorily completed within thirty (30) days of the date of the Substantial Completion, and identifying responsibilities for security, maintenance, and insurance. This list may include items in addition to those on the Contractor's punchlist, which the inspection team deems necessary to correct or complete prior to Final Inspection. If the Owner occupies the facility upon determination of Substantial Completion, the Contractor shall complete all corrective Work at the convenience of the Owner, without disruption to Owner’s use of the facility for its intended purposesCompletion Inspection Deadline.

Substantial Completion Inspection. When the Contractor Design-Builder considers that the entire Work or part thereof is Substantially Complete, it the Architect, Design-Builder, and Owner and Owner’s Representative shall inspect the Work. Based upon the Substantial Completion Inspection, the Owner shall prepare, coordinate, and submit to the Design-Builder a detailed list of all remaining Work to be completed or corrected in the Work (the Design-Builder’s Substantial Completion Punch List). The Design- Builder’s Substantial Completion Punch List will identify all work necessary to be completed or corrected prior to issuance of the Substantial Completion Certificate, and the remaining items the Design-Builder shall correct prior to Final Payment. The Design-Builder shall promptly correct all items listed on the Substantial Completion Inspection List as a condition to the Owner’s Certification of Substantial Completion. The Design-Builder shall notify Owner when all items in the ODR in writing that the Work will be ready Substantial Completion Punch List necessary for Substantial Completion Inspection on a specific dateare complete and correct, and request inspection by the Owner. The Contractor shall include Owner will make an inspection to determine whether the Substantial Completion Punch List is complete. If the Owner’s inspection discloses any item, which is not sufficiently complete in accordance with this notice the Contractor’s Punchlist to indicate Design-Build Documents so that it has previously inspected all the Owner can occupy or utilize the Work associated with or designated portion thereof for its intended use, the Design-Builder shall, before issuance of the Certificate of Substantial Completion, complete or correct such item upon notification by the Owner. In such case, the Design- Builder shall then submit a request for another inspection by the Owner to determine Substantial Completion. After the second inspection, has corrected items where possiblethe Design-Builder shall be responsible for all costs incurred by Owner to re-inspect the Work a third, and includes all items scheduled for completion fourth or correction prior more time to final inspectiondetermine Substantial Completion, provided the re-inspection is due to Design- Builder’s fault. This list may include items in addition to those on the Contractor's punchlist, which the inspection team deems necessary to correct or complete prior to Final Inspection. If the ODR determines concurs with the AE and CM-at-Risk in a determination that the Work is Substantially Complete, the ODR will issue a Certificate of Substantial Completion to be signed by the A/EAE, Owner and ContractorCM-at-Risk, establishing the date of Substantial Completion, Completion and identifying responsibilities for security, maintenance, and insurance. A/E AE will provide with this certificate a list of punchlist items (the Pre-Final Punchlist) for completion prior to final inspection. This list may include items in addition to those on the ContractorCM-at-Risk's punchlist, which the inspection team deems necessary to correct or complete prior to Final Inspection. Substantial Completion Inspection. When the Contractor considers the entire Work or part thereof Substantially Complete, it shall notify the ODR OCM in writing that the Work will be ready for Substantial Completion Inspection inspection on a specific date. The Contractor shall include with this notice the Contractor’s Punchlist to indicate that it has previously inspected all the Work associated with the request for inspection, noting items it has corrected and included all remaining work items where possible, and includes all items with date scheduled for completion or correction prior to final inspection. The failure to include any items on this list does not alter the responsibility of the Contractor to complete all Work in accordance with the Contract Documents. If any of the items on this list prevents the facility Project from being used as intended, the Contractor shall not request a Substantial Completion Inspectioninspection. The Owner and its representatives will review the list of items and schedule the requested inspection, or inform the Contractor in writing that such an inspection is premature because the Work is not sufficiently advanced or conditions are not as represented on the Contractor's ’s list. 12.1.1.1 15.1.5.1 Prior to the Substantial Completion Inspectioninspection, the Contractor shall furnish a copy of its marked-up As-Built Drawings Record Documents and a preliminary copy of each instructional manual, maintenance and operating manual, parts catalog, wiring diagrams, spare parts, specified written warranties warranties, and like publications or parts for all installed equipment, systems systems, and like itemsitems as described in the Contract Documents. Delivery of these items is a prerequisite for requesting the Substantial Completion Inspectioninspection. 12.1.1.2 15.1.5.2 On the date requested by Contractor, or as mutually agreed upon pending the status of the open items listOpen Items List, the A/EDesign Professional, ODROCM, the Contractor Contractor, and other Owner representatives as determined by the Owner, Owner will jointly attend the Substantial Completion Inspectioninspection, which shall be conducted by the ODR OCM or their delegateOwner’s representative. If the ODR Owner and Design Professional determines that the Work is Substantially Complete, the ODR Design Professional will issue a Certificate of Substantial Completion to be signed by the A/EDesign Professional, Owner Owner, and Contractor, Contractor establishing the date of Substantial Completion, Completion and identifying responsibilities for security, security and maintenance, and insurance. A/E Design Professional will provide with this certificate a list of punchlist Punchlist items (the Prepre-Final final Punchlist) for completion prior to final inspection. This list may include items in addition to those on the Contractor's punchlist’s Punchlist, which the inspection team deems necessary to correct or complete prior to Final Inspectionfinal inspection. If the Owner occupies the facility Project upon determination of Substantial Completion, the Contractor shall complete all corrective Work at the convenience of the Owner, without disruption to Owner’s use of the facility Project for its intended purposes.
