SUBSTITUTION OF MATERIAL OR EQUIPMENT. 1.8.1 Where an item or MATERIAL is specified by a trade or manufacturer's name, it is done for the purpose of establishing a basis of quality, and not for the purpose of limiting competition. ENGINEER’S intent is to consider alternative products which have the desired essential characteristics. PM/CM in consultation with ENGINEER will consider any such product offered. Requests for approval of alternative products shall be made through BIDDERS bidding as prime contractors. No approvals for substitutions will be granted directly to suppliers, distributors, or subcontractors. Pursuant to A.R.S. § 34-104-C, the following procedures will be used:
SUBSTITUTION OF MATERIAL OR EQUIPMENT. 1. All Bidders must submit their proposals in strict accordance with materials mentioned in the specifications as their base bid. 2. Bidders may submit substitutions if approved by the Empire Apartments representative based on materials or equipment other than that specified by name in the specifications. 3. All substitutions and alternates must be submitted as a voluntary alternate to the base bid. In no event, can substitutions or alternates be submitted unless a separate bid is also submitted in strict conformance with the specifications. 4. Bidder must state alternate’s name, manufacture, type or brand of material or equipment and deduction from base bid with his proposal. 5. Substitute materials or equipment must meet all requirements as to type, quality, and function as that originally specified. 6. Acceptance of a substitute article, material or piece of equipment, shall be subject to approval. Bidder shall submit upon request, complete engineering data to indicate comparable quality, design, and efficiency of alternate.

  • Condition of the Contractor’s Property or Equipment The Contractor shall make the Property and/or equipment available to the Judicial Council, pursuant to the terms and conditions set forth in this Agreement. The Contractor shall immediately remedy any problem with the Property’s physical plant or equipment that impairs or diminishes the quality of the Program. The Contractor shall ensure the appropriate hot water, heating, and ventilation is provided at the Property during the Program, inclusive in the prices set forth herein.

  • REPAIRED OR REPLACED PARTS / COMPONENTS Where the Contractor is required to repair, replace or substitute Product or parts or components of the Product under the Contract, the repaired, replaced or substituted Products shall be subject to all terms and conditions for new parts and components set forth in the Contract including Warranties, as set forth in the Additional Warranties Clause herein. Replaced or repaired Product or parts and components of such Product shall be new and shall, if available, be replaced by the original manufacturer’s component or part. Remanufactured parts or components meeting new Product standards may be permitted by the Commissioner or Authorized User. Before installation, all proposed substitutes for the original manufacturer’s installed parts or components must be approved by the Authorized User. The part or component shall be equal to or of better quality than the original part or component being replaced.

  • Quality of Materials and workmanship The Contractor shall ensure that the Construction, Materials and workmanship are in accordance with the requirements specified in this Agreement, Specifications and Standards and Good Industry Practice.

  • Additional Requirements for Sleeping Rooms The Contractor shall provide departing Attendees a secured area for storing belongings.
