Supported Platforms. GWHK supports those platforms and associated compilers set forth on Annex 1 to this Schedule 1 (each, a "Supported Platform"). GWHK reserves the right to modify the list of platforms and associated compilers that it supports on a quarterly basis, provided, however, that GWHK will continue to support any listed platform until the date which is one (1) month following the termination of support for the listed release by the platform vendor. At the discretion of GWHK, GWPM may receive support services from GWHK for any platform other than a Supported Platform pursuant to a separate written agreement between GWPM and GWHK which may require additional payments by GWPM to GWHK in consideration of hardware and/or other costs and expenses necessary to provide such services to Customer. Annex 1 to this Schedule 1 represents the recommended release levels of the Supported Platforms, including associated compilers (if applicable) as of the Effective Date.

Supported Platforms. Voilà! supports and is tested on the last two versions of the most popular web browsers, including Chrome (web and mobile), Safari (web and mobile), Edge and Firefox. It also supports the most up to date versions of iOS and Android. To make sure they can access Voilà!, clients are responsible for making sure their employees use up-to- date versions of a supported browser or mobile operating system. It is understood that Voilà! cannot support every past version of such browsers and operating systems, which could create security breaches or performance issues.
Supported Platforms. Where applicable, SBCTC will provide to the College a list of supported platforms and technologies (browser versions, settings, plug-ins, etc.). When SBCTC or its vendors receive requests for support where the user’s hardware and/or software does not conform to the standards published by the vendor, SBCTC shall, if resources are available, make a “best effort” attempt to assist the user. SBCTC is not responsible for errors created by third party software, flaws in the ANGEL code, or errors in the course content created by the College’s users (e.g. mistakes in faculty generated quizzes and tests).

In no event shall the Administrative Agent or any of its Related Parties (collectively, the “Agent Parties”) have any liability to the Borrower, any Lender, the L/C Issuer or any other Person for losses, claims, damages, liabilities or expenses of any kind (whether in tort, contract or otherwise) arising out of the Borrower’s or the Administrative Agent’s transmission of Borrower Materials through the Internet, except to the extent that such losses, claims, damages, liabilities or expenses are determined by a court of competent jurisdiction by a final and nonappealable judgment to have resulted from the gross negligence or willful misconduct of such Agent Party; provided, however, that in no event shall any Agent Party have any liability to the Borrower, any Lender, the L/C Issuer or any other Person for indirect, special, incidental, consequential or punitive damages (as opposed to direct or actual damages).

  • Interfaces GTE provides the CLECs with choices for access to OSS pre-ordering, ordering, maintenance and repair systems. Availability of the interfaces is fundamental to the CLEC being able to effectively do business with GTE. Additionally, in many instances, CLEC personnel must work with the service personnel of GTE. Measurements in this category assess the availability to the CLECs of systems and personnel at GTE work centers.

  • Software Title and ownership to Existing Software Product(s) delivered by Contractor under the Contract that is normally commercially distributed on a license basis by the Contractor or other independent software vendor proprietary owner (“Existing Licensed Product”), embedded in the Custom Products, shall remain with Contractor or the proprietary owner of other independent software vendor(s) (ISV). Effective upon acceptance, such Product shall be licensed to Authorized User in accordance with the Contractor or ISV owner’s standard license agreement, provided, however, that such standard license, must, at a minimum: (a) grant Authorized User a non-exclusive, perpetual license to use, execute, reproduce, display, perform, adapt (unless Contractor advises Authorized User as part of Contractor’s proposal that adaptation will violate existing agreements or statutes and Contractor demonstrates such to the Authorized User’s satisfaction) and distribute Existing Licensed Product to the Authorized User up to the license capacity stated in the Purchase Order or work order with all license rights necessary to fully effect the general business purpose(s) stated in the Bid or Authorized User’s Purchase Order or work order, including the financing assignment rights set forth in paragraph (c) below; and (b) recognize the State of New York as the licensee where the Authorized User is a state agency, department, board, commission, office or institution. Where these rights are not otherwise covered by the ISV’s owner’s standard license agreement, the Contractor shall be responsible for obtaining these rights at its sole cost and expense. The Authorized User shall reproduce all copyright notices and any other legend of ownership on any copies authorized under this clause. Open source software is developed independently of Contractor and may be governed by a separate license (“open source software”). If the open source software is governed by a separate License and provided under this Contract, Contractor shall provide a copy of that license in the applicable Documentation and the Authorized User's license rights and obligations with respect to that open source software shall be defined by those separate license terms and subject to the conditions, if any, therein. Nothing in this Contract shall restrict, limit, or otherwise affect any rights or obligations the Authorized User may have, or conditions to which the Authorized User may be subject, under such separate open source license terms.

  • Programming (a) Pursuant to Section 624 of the Cable Act, the Licensee shall maintain the mix, quality and broad categories of Programming set forth in Exhibit 4, attached hereto and made a part hereof. Pursuant to applicable federal law, all Programming decisions, including the Programming listed in Exhibit 4, attached hereto, shall be at the sole discretion of the Licensee.

  • Promotional Materials In the event that the Fund or the Adviser makes available any promotional materials related to the Securities or the transactions contemplated hereby intended for use only by registered broker-dealers and registered representatives thereof by means of an Internet web site or similar electronic means, the Adviser will install and maintain, or will cause to be installed and maintained, pre-qualification and password-protection or similar procedures which are reasonably designed to effectively prohibit access to such promotional materials by persons other than registered broker-dealers and registered representatives thereof.
