Common use of Surrender of Facilities Clause in Contracts

Surrender of Facilities. Within five (5) business days after any termination of this Agreement, but subject to Section 5.2, Xxxxxx shall, vacate the Transmitter Site, remove all of its assets from the Transmitter Site, surrender the Transmitter Site in substantially the same condition existing on the Dayton Commencement Date (reasonable wear and tear excepted) and surrender to Sharer all keys and other means of entry to the Transmitter Site.

Within five thirty (530) business days after the effective date of any termination of this Agreement, but subject to Section 5.25.1(c), Xxxxxx shall, shall vacate the Transmitter Site, remove all of its assets from the Transmitter Site, surrender the Transmitter Site in substantially the same condition existing on the Dayton Sharing Commencement Date (reasonable wear and tear excepted) and surrender return to Sharer all keys and other means of entry to the Transmitter Site.
