Surrender of the Premises. Upon the expiration or earlier termination of this Lease, or upon the exercise by Landlord of its right to re-enter the Premises without terminating this Lease, Tenant shall immediately surrender the Premises to Landlord, together with all alterations, improvements and other property as provided elsewhere herein, in broom-clean condition and in good order, condition and repair, except for ordinary wear and tear and damage which Tenant is not obligated to repair, failing which Landlord may restore the Premises to such condition at Tenant's expense. Surrender of the Premises. Upon Immediately prior to the expiration or earlier upon the sooner termination of this Lease, Tenant shall remove all Tenant's Trade Fixtures and other personal property, and shall vacate and surrender the Premises to Landlord in the same condition as existed at the Commencement Date, except for (i) reasonable wear and tear, (ii) damage caused by any peril or upon condemnation, and (iii) contamination by Hazardous Materials for which Tenant is not responsible pursuant to subparagraphs 7.2B or 7.2C. In this regard reasonable wear and tear shall be construed to mean wear and tear caused to the exercise Premises by the natural aging process which occurs in spite of prudent application of reasonable standards for maintenance, repair and janitorial practices, and does not include items of neglected or deferred maintenance. If Landlord so requests, Tenant shall, prior to the expiration or sooner termination of this Lease, remove any Leasehold Improvements designated by Landlord of its right and repair all damage caused by such removal if such removal is required pursuant to re-enter paragraph 5.2. If the Premises without terminating are not so surrendered at the termination of this Lease, Tenant shall immediately surrender the Premises be liable to Landlord, together with Landlord for all alterations, improvements and other property as provided elsewhere herein, costs incurred by Landlord in broom-clean condition and in good order, condition and repair, except for ordinary wear and tear and damage which Tenant is not obligated to repair, failing which Landlord may restore the Premises to such condition at Tenant's expense. Upon such expiration or termination, Tenant may, provided Tenant is not in default and unless prohibited from doing so by other provisions of this Lease, have the right to remove its personal property and trade fixtures. Tenant shall promptly repair any damage caused by any such removal, and shall restore returning the Premises to the condition existing prior to required condition, plus interest on all costs incurred at the installation of the items so removed, ordinary wear and tear and damage which Tenant is not obligated to repair excepted. If Tenant fails to remove any and all such trade fixtures from the Premises on the Expiration Date or earlier termination of this Lease, all such trade fixtures shall become the Property of Landlord, unless Landlord elects to require their removal, in which case Tenant shall, at its cost, promptly remove the same and restore the Premises to its prior conditionAgreed Interest Rate.

Surrender of the Premises. Upon such expiration or termination, Tenant may, provided Tenant is not in default and unless prohibited from doing so by other provisions of this Lease, have the right to shall also remove its personal property property, trade fixtures and trade fixtures. Tenant shall any of Tenant's alterations designated by Landlord; promptly repair any damage caused by any such removal, ; and shall restore the Leased Premises to the condition existing prior to the installation of the items so removed, ordinary wear and tear and damage which Tenant is not obligated to repair excepted. If Tenant fails to remove do so, Landlord may restore the Leased Premises to such condition at Tenant's expense, and Landlord may cause all of said property to be removed at Tenant's expense and Tenant hereby agrees to pay all the costs and expenses thereby reasonably incurred. All property of Tenant which is not removed within ten (10) days following Landlord's written demand therefor shall be conclusively deemed to have been abandoned by Tenant, and Landlord shall be entitled to dispose of such property without thereby incurring any and all such trade fixtures from liability to Tenant. The provisions of this section shall survive the Premises on the Expiration Date expiration or earlier other termination of this Lease, all such trade fixtures shall become the Property of Landlord, unless Landlord elects to require their removal, in which case Tenant shall, at its cost, promptly remove the same and restore the Premises to its prior condition.
