The 'Survey Materials' clause defines the requirements and responsibilities related to the provision, use, and ownership of materials generated or used during a survey process. Typically, this clause specifies which party is responsible for supplying necessary documents, data, or equipment, and may address issues such as confidentiality, return, or destruction of materials after the survey is completed. Survey Materials. 3.1 If a Proficiency Testing Survey requires any specific Survey Materials (which, for clarity, may also be referred to as Product(s)), such Survey Materials will be shipped to the Customer at the address as identified in the Quotation, or such other address as may be notified in writing by the Customer no later than seven (7) days prior to the applicable scheduled shipment date (“Delivery Address”). Any such change of Delivery Address shall only apply to future deliveries of Survey Materials. The delivery of Survey Materials is “as is” and “when available” and the Customer’s participation in the Proficiency Testing Responsible: Team Lead, Client Relations and Operational Support Authorized by: Director, Proficiency Testing Version Date: 2021-08-12 Survey is dependant on, in IQMH’s sole opinion, the availability of the applicable Survey Materials and a suitable means of transportation/shipping, and any applicable import or export customs clearances. 3.2 The Customer agrees to comply, and cause Customer Personnel to comply, with the handling, storage, use and other information (which in certain cases may include Intellectual Property rights) as notified in writing on the labels and/or inserted documentation contained in/on the package or packaging of the Survey Materials (collectively, “Packaging Information”). IQMH shall not be liable hereunder for any act or omission or negligence related to the Customer’s, or Customer Personnel’s, non- compliance with the Packaging Information.
Survey Materials. Within five (5) days after the full execution of the Contract of Sale, Seller shall furnish to GDE, at Seller's sole cost and expense, copies of any existing survey(s) of all or any portion of the Property, together with any existing title policy or policies either in its possession or readily obtainable at no or minimal cost, by Seller (the "Survey"). Seller shall also deliver to GDE any existing third-party reports or studies including but not limited to geotechnical, environmental, architectural, marketing, and traffic conducted, or in reference to, the Property.
