Survival of Certain Employment Agreement Provisions. Executive agrees that the provisions of Executive Confidentiality and Non-Compete Agreement (as referenced in Section 1(d) of the Employment Agreement) as in effect as of the Termination Date survives the termination of Executive’s employment with Company.

Survival of Certain Employment Agreement Provisions. Executive agrees that the provisions of the Executive Confidentiality and Non-Compete Agreement (as referenced set forth in Section 1(d) Appendix B of the Employment Agreement (the "Restrictive Covenants Agreement") as in effect as and the provisions of Sections 7 (Nondisparagement) and 10 of the Termination Date survives Employment Agreement (Indemnification) survive the termination of Executive’s 's employment with Company.

The Executive agrees that the provisions of Executive Confidentiality Section 11 (Confidential Information, Non-Competition and Non-Compete Agreement (as referenced in Section 1(d) Solicitation of the Employment AgreementCompany) as in effect as of the Termination Date survives survive the termination of the Executive’s employment together with Companyany applicable definitions (as may be amended herein) used in such Sections contained in the Employment Agreement (collectively, the “Surviving Provision”).
