Survival of Xxxxxx’s and the Purchaser’s Representations and Warranties. The representations and warranties of Marble and the Purchaser contained in this Agreement or any document or certificate given pursuant to this Agreement shall survive the Closing for the benefit of the Vendor for a period of 24 months, unless a bona fide notice of a Claim for indemnity shall have been given in writing before the expiry of that period, in which case the representation and warranty to which such notice applies shall survive in respect of that Claim until the final determination or settlement of that Claim.
