Common use of Suspension and Discharge Procedure Clause in Contracts

Suspension and Discharge Procedure. (a) An employee who has completed his/her probationary period may be dismissed, but only for just cause. (b) When an employee is discharged, suspended or reprimanded, such an employee shall be advised in writing within twenty-one (21) calendar days by the Employer of the reason for such discharge, suspension, or reprimand. (c) Where it is determined that an employee has been suspended or discharged in violation of Clause 10.03(b), that employee shall be immediately reinstated to his/her former position without loss of seniority, and shall be compensated for all time lost in an amount equal to his/her normal earnings during the pay period next preceding such suspension or discharge. (d) When an employee is required to attend a meeting with the Employer which concerns an oral reprimand or which precedes a written warning, the Employer shall advise the employee that he/she has a right to be accompanied by a representative of the Association.
