Common use of Suspension of Delivery Clause in Contracts

Suspension of Delivery. FIMER shall have the right to suspend deliveries where the Customer fails to make a single payment by the agreed deadline, or proves to be a defaulter under another agreement or other general obligations towards FIMER. FIMER may also suspend deliveries after the conclusion of the Agreement, in the event that the Customer’s economic conditions substantially change, as in the case of one or more complaints, enforcement actions, constitution of pledges and/or mortgages, request for receivership, pre-bankruptcy agreement among creditors, or cessation of activity.
