SCOPE OF DELIVERY. Seller agrees to accept deliveries of natural gas belonging to Buyer at Seller's delivery point from the upstream pipeline located near Columbia, South Carolina, and to transport Buyer's gas and redeliver to Buyer. Service provided hereunder is in lieu of natural gas provided from Seller's system supply to satisfy Buyer's fuel requirements in Priority-of-Service Category 3C. Xxxxx agrees that the transportation service is provided on an interruptible basis. Interruptions of transportation service shall be at the sole discretion of Seller or whenever service is interrupted by any upstream pipeline.
SCOPE OF DELIVERY. FIRM GAS, PRIORITY-OF-SERVICE CATEGORY 2 Xxxxx agrees to purchase from Seller, and Xxxxxx agrees to sell to Buyer, up to the Maximum Daily Quantity of natural gas which shall not be subject to interruption or curtailment except for conditions as set forth in Article IV, Paragraph 3, of the General Terms and Conditions hereto attached. The Maximum Daily Quantity of Firm Gas shall be 50 dekatherms per day. Any gas taken by Buyer above the Maximum Daily Quantity, after notice from Seller of curtailment to the Maximum Daily Quantity, without Seller's advance approval, shall be Unauthorized Overrun Gas and shall subject Buyer to the penalty rate per dekatherm set forth in Article IV, Paragraph 5, of the General Terms and Conditions to Industrial Service Agreements hereto attached. Deliveries of Firm Gas under this paragraph of the Service Agreement shall be utilized by Buyer only in Priority-of-Service Category 2 as set forth in Article III, Paragraph 1, of the General Terms and Conditions hereto attached. Buyer shall purchase all gas tendered by Seller up to the Maximum Daily Quantity whenever and to the extent Buyer has a requirement for fuel in the Priority-of-Service Category set forth herein. . HOURLY DELIVERIES Seller shall not be obligated to make hourly deliveries of gas pursuant to Paragraph 1 above at an hourly rate exceeding 10 dekatherms per hour. Seller reserves the right to regulate the flow of gas delivered hereunder by means of automatic or manually operated flow control valves so as to limit the hourly flow of gas within the specified quantity. , POINT OF DELIVERY The Point of Delivery for all gas delivered hereunder shall be at the outlet side of Seller's measuring and regulating equipment. The measuring equipment shall be installed on the Buyer's property at a location mutually agreed upon by Seller and

Deliveries of Film Gas under this paragraph of the Service Agreement shall be utilized by Buyer only in Priority-of-Service Category 1 as set forth in Article III, Xxxxxxxxx 0, the General Terms and Conditions hereto attached. Buyer shall purchase all gas tendered 'by Seller up to the Maximum Daily Quantity whenever and to the extent Buyer has a requirement for fuel in the Priority-of-Service Category set forth herein.

Service provided hereunder is in lieu of natural gas provided from Seller's system supply to satisfy Buyer's fuel requirements in Priority-of-Service Category
SCOPE OF DELIVERY. In the event a daily volume is delivered to Seller which exceeds the Contract Maximum Daily Quantity, the excess daily volumes will be purchased by Seller at Seller's lowest delivered price from any of Seller's suppliers.
SCOPE OF DELIVERY. 2.1. The scope of the delivery confirmed by the Seller in writing shall be decisive. All offers are non-binding. No Agreement has been made until Seller has confirmed the order of Buyer in writing. In the absence of such written confirmation, the offer of Seller shall apply.
2.2. The delivery of the equipment (“Equipment”) includes all components, materials and services expressly specified in the Agreement.
2.3. The delivery includes Seller’s standard technical documents, such as operating manuals and erection instructions (if the erection is not included in the scope of delivery) and main dimension drawings in English. Seller shall not be obliged to provide manufacturing drawings for the Equipment or spare parts.
2.4. Design, work at site, erection, supervision of erection, training services, start-up assis- tance and materials other than crane components are included to the extent they are expressly specified in the Agreement.
SCOPE OF DELIVERY. Only the written order confirmation determines the scope of delivery / service. Collateral agreements and chan- ges require written confirmation. We reserve the right to make changes in design and form, provided that no fundamental changes are made which are unreasonable for the ordering party.

SCOPE OF DELIVERY. 1. The written order confirmation from MAN shall be authoritative for the scope of delivery. The MAN installation guidelines applicable in each case must be com- plied with by the Purchaser.
2. The provisions of the Verband Deutscher Elektrotechniker (Association of German Electrical Engineers) shall apply to electrical material.
3. If the object of purchase is to be used outside the Federal Republic of Germany, the scope of delivery for industrial and environmental protection equipment shall be based on the agreement reached. The Purchaser shall be responsible for compliance with the legal or other provisions for the export of the object of pur- chase and/or at the location it is to be used unless agreed otherwise.
4. If customary commercial clauses are agreed for the type of delivery, the Inco- terms of the International Chamber of Commerce in Paris in the version in force on the date the Agreement was concluded shall apply to their interpretation.
5. All public charges (taxes, fees, customs duties, etc.) that accrue from or in connection with the conclusion or settlement of the Agreement outside the Federal Republic of Germany shall be paid by the Purchaser.
SCOPE OF DELIVERY. Seller aclmowledges that Buyer may utilize a source of gas other than system supply gas from Seller's sources. Xxxxx's gas may be transported to Buyer by Seller under the Transpmiation services provision of this Agreement. Natural gas is provided hereunder to satisfy Buyer's requirements when Seller is not providing transportation services. Xxxxx agrees to purchase from Seller, and Xxxxxx agrees to sell to Buyer, up to the Maximum Daily Quantity of natm;al gas which shall not be subject to interruption or cmiailment except for conditions as set forth in Atticle IV, Paragraph 3, of the General Terms and Conditions hereto attached. The Maximum Daily Quantity of Firm Gas shall be 60 dekatherms per day. Any gas taken by Buyer above the Maximum Daily Quantity, without Seller's advance approval, shall be Unauthorized Overrun Gas and shall subject Buyer to the penalty rate per dekatherm set forth in Article IV, Paragraph 5, of the General Terms and Conditions to Industrial Service Agreements hereto attached. Deliveries of Firm Gas under this paragraph of the Agreement shall be utilized by Xxxxx only in Priority-of-Service Category 3A as set forth in Article III, Paragraph 1, of the General Terms and Conditions hereto attached. Buyer shall purchase all gas tendered by Seller up to the Maximum Daily Quantity whenever and to the extent Buyer has a requirement for fuel in the Priority-of-Service Category set forth herein.
