Common use of Suspension or Revocation of License Clause in Contracts

Suspension or Revocation of License. In the event an employee receives a traffic citation for a moving violation while on duty which would contribute to a suspension or revocation or suffers a suspension or revocation of the right to drive the Employer's equipment for any reason, the employee must promptly notify the Employer in writing. Failure to comply will subject the employee to disciplinary action up to and including discharge. An employee failing or unable to return to work as a result of such suspension or revocation of the right to drive the Employer's equipment shall be allowed to retain seniority for a period not to exceed the term of suspension plus thirty (30) days with a maximum of three (3) years. Failure of the employee to successfully reinstate his driving privileges during this period of time shall result in the termination of his/her seniority. If such suspension or revocation comes as a result of the employee complying with the Employer's instruction, which results in a succession of size and weight penalties or because the employee complied with the Employer's instruction to drive its equipment which is in violation of D.O.T. regulations relating to equipment or because its equipment did not have a speedometer in proper working order which has been reported to the Employer, except in unusual circumstances, and if the employee has notified the Employer of the citation for such violation as mentioned above, the Employer shall provide employment to such employee at not less than the employee's regular earnings at the time of such suspension for the entire period thereof, subject however to the seniority and layoff provisions applicable to the employee at time of the suspension. An employee unable to successfully pass the D.O.T. Commercial Driver's License (CDL) examination will be allowed to retain seniority for a period not to exceed one (1) year provided the employee makes a good faith effort to pass the test each time the opportunity presents itself. During this leave of absence the Employer shall have no obligation to make health and welfare or pension contributions on behalf of the employee.
