Target Volumes. [15] The parties agree to negotiate in good faith to establish a target volume of Products on an annual basis (measured from the “Effective Date” of this Agreement) (“Target Volumes”), and to determine expected corresponding quarterly volumes thereof (“Quarterly Volumes”).
Target Volumes. Supplier will serve as Purchaser’s primary provider of the Product, with an initial monthly volume target of 2,000-3,000 kilograms. Target Volumes. 5.3.1 Subject to the terms and conditions of this Agreement, for each year commencing on May 1, 2014 (such 12 month period being referred to as the “Contract Year”) and during the term of this Agreement, STR intends to purchase from Manufacturer not less than fifteen million (15,000,000) square meters of Licensed Products (hereinafter called “Annual Target Volume”). 5.3.2 In the event that STR believes that it may fail to satisfy the Annual Target Volume in any Contract Year, STR shall promptly notify Manufacturer and the Parties shall, in good faith, renegotiate the amount of the Annual Target Volume. If the Parties fail to reach a written agreement on adjustment of the Annual Target Volume within forty five (45) days upon Manufacturer receiving the written notice from STR, either Party may terminate this Agreement upon a forty five (45)-day notice without the payment of any penalties or premiums. 5.3.3 In the event that Manufacturer believes that it may not be able to supply Licensed Products to STR in accordance with the forecast delivered by STR, Manufacturer shall immediately notify STR of such fact. Notwithstanding anything to the contrary in this Agreement, STR shall be entitled to obtain any such shortfall from third parties.
Target Volumes. Subject to the terms and conditions set forth herein, Fuels and LW shall endeavor in a commercially reasonable manner to arrange for Product sales (taking into account sales to the SIP) in such volumes so that, as of the end of each calendar month, the volume of each Product held by Macquarie in the Storage Facilities is as close as reasonably practicable to the Target Month End Product Volume for such Product.

  • Volumes The Authority gives no guarantees of volumes. Any volumes mentioned in this Contract, are indicative only and shall not be binding on the Authority.

Kindred items shall receive the same percentage of discount or pricing structure as items listed in the specification document. 1.4 The unit prices and the extended total prices shall be used as a basis for the evaluation of bids.   • ESTIMATED / SPECIFIC QUANTITY CONTRACTS Estimated quantity contracts, also referred to as indefinite delivery / indefinite quantity contracts, are expressly agreed and understood to be made for only the quantities, if any, actually ordered during the Contract term. No guarantee of any quantity is implied or given. With respect to any specific quantity stated in the contract, the Commissioner reserves the right after award to order up to 20% more or less (rounded to the next highest whole number) than the specific quantities called for in the Contract. Notwithstanding the foregoing, the Commissioner may purchase greater or lesser percentages of Contract quantities should the Commissioner and Contractor so agree. Such agreement may include an equitable price adjustment.
