Tax Elections and Information. (a) The Company is authorized and has elected to be treated as an association taxable as a corporation for U.S. federal income tax purposes. (b) Except as otherwise provided herein, the Managing Member shall determine whether the Company should make any other elections permitted by the Code. (c) The tax information reasonably required by Record Holders for U.S. federal income tax reporting purposes shall be furnished to Record Holders on or before the date required under the Code and treasury regulations thereunder, but in any event no later than 90 days after the close of each calendar year.
