TDSO’ s participation in this Agreement may be summarily suspended for breach of this Agreement in the event that TDSO is in material default of the performance of a duty or obligation imposed upon it by this Agreement. TDSO’s participation in this Agreement may be summarily suspended upon completion of a preliminary investigation and determination by the NJHIN Manager, on behalf of NJDOH, that there is a substantial likelihood that TDSO‘s acts or omissions will create, or have created, an immediate threat or will cause irreparable harm to the NJHIN, NJDOH, NJII and/or to another one or more TDSO, and/or to the integrity of the operation of the NJHIN, and/or to an Individual whose Message Content is transacted through the NJHIN. Written notice of temporary suspension of a TDSO in the NJHIN shall be provided by the NJHIN Manager and shall set forth the reasons for and the operative date of TDSO’s suspension. The temporary suspension notice shall be submitted to the offending TDSO no later than five (5) business days after initiation of the temporary suspension. Any reference in this DURSA to the termination of the DURSA shall automatically include termination of the TDSO’s connection to the NJHIN.
