Teachers who fail to give Notice. (a) If a teacher fails to give the notice specified in clause 12.3, an amount not exceeding the amount the teacher would have been paid under this Agreement in respect of the period of notice required by this clause less any period of notice actually given by the teacher, shall be payable by the teacher to the School. (b) In accordance with section 324 of the Act, with the written authorisation of the teacher, the School may withhold from any monies due to the teacher on termination under this Agreement, an amount not exceeding the amount the teacher would have been paid under this Agreement in respect of the period of notice required by this clause less any period of notice actually given by the teacher. Any outstanding balance becomes a debt due and payable by the teacher.

(b) In accordance with section 324 s324 of the Act, with the written authorisation of the teacher, the School school may withhold from any monies due to the teacher on termination under this Agreement, an amount not exceeding the amount the teacher would have been paid under this Agreement in respect of the period of notice required by this clause less any period of notice actually given by the teacher.
