TELUS' liability for the performance Sample Clauses

TELUS' liability for the performance of its obligations pursuant to this Agreement shall be the one set out in TELUS XX0-0-0 Xxxxxx (XXXX 00000 Item 1001). It being understood that TELUS' limited liability under this Agreement is a condition without which TEUS would not have entered into this Agreement and therefore, TELUS' liability for the performance of its obligations pursuant to this Agreement shall not exceed any limitation of liability set out under TELUS XX0-0-0 Xxxxxx (XXXX 00000 Item 1001) even if such limitation of liability does not specifically apply or refer to the LGA.

  • Security for Performance In the event that Exhibit A Section 4 indicates the need for Consultant to provide additional security for performance of its duties under this Agreement, Consultant shall provide such additional security prior to commencement of its Required Services in the form and on the terms prescribed on Exhibit A, or as otherwise prescribed by the City Attorney.

  • Liability for Breach of Contract 1. Any Party who violates the provisions of this Agreement and makes all or part of this Agreement unenforceable, shall be liable for breach of contract and shall compensate the other Party for the losses caused thereby (including the litigation fees and attorney fees caused thereby). If both Parties breach this Agreement, each shall bear the corresponding responsibility according to the actual situations.

  • Continuing Performance Each party is required to continue to perform its obligations under this contract pending final resolution of any dispute arising out of or relating to this contract, unless to do so would be impossible or impracticable under the circumstances.
