Temporary Breach a) many courts hold that policy is merely suspended during breach and is revived when the breach is cured, where: (1) Warranty or condition is only temporarily breached, (2) Insurer does not take action to have the policy voided before the breach is cured, and (3) The risk is not substantially increased during the period of the breach. b) If the temporary breach is not material, then coverage still available.
