Common use of Temporary Judge Clause in Contracts

Temporary Judge. Not later than five (5) Business Days after service and filing of the answer, the parties shall stipulate that the case shall be heard and determined for all purposes by a retired judge of the Superior Court for the County where the case was filed, appointed and sitting without a jury as a temporary judge pursuant to California Constitution Article VI, Section 21. In the event that the parties cannot agree within fifteen (15) days after service and filing of the answer on the retired judge to be appointed as temporary judge, one shall be appointed, upon the request of either party, by the Presiding Judge of the Superior Court for the County where the case was filed.
