Temporary Shutdowns Clause Samples
The Temporary Shutdowns clause allows for the suspension of operations or services for a limited period under specified circumstances. Typically, this clause outlines the conditions under which a shutdown may occur, such as safety concerns, regulatory requirements, or unforeseen events, and may detail the procedures for notification and resumption of activities. Its core function is to provide a clear framework for pausing operations without breaching the contract, thereby managing risk and ensuring both parties understand their rights and obligations during temporary interruptions.
Temporary Shutdowns. Toppan may shut down the Covered System temporarily by providing advance written notice or, in the case of any emergency, notice after the fact, upon the occurrence of any of the following events:
(a) when conducting maintenance or inspection of the Covered System and servers;
(b) if there is a disruption to the Covered System;
(c) if a Type 1 Telecommunications Carrier or another telecommunications carrier suspends service and the suspension negatively affects the Covered System’s operations;
(d) if a Force Majeure Event occurs;
(e) if Toppan determines that suspension of the Covered System is necessary for other operational or technical reasons. Toppan will bear no liability for Company’s inability to use the Covered System during a shutdown caused by any of the events described in this ARTICLE III.
Temporary Shutdowns. Service time shall not apply during shutdowns instituted by Federal, State or local licencing and reimbursement authorities.
Temporary Shutdowns. When an occupation ceases by reason of shutdown of any part of the ▇▇▇▇▇ for some unavoidable cause, the Company will, insofar as is possible, endeavour to retain the employees affected at other occupations; it being understood that the rate of pay of such occupations will be as covered by the wage scale attached hereto. 406 Temporary Night Crew Transition To facilitate the transition of a temporarily assigned night crew back to day work after completion of emergency work, and prior to a scheduled workday, the night crew will work on 4 - 12 shift at time and one-half rate before returning to their regular day work on the following day. 407 Coffee Break There will be a paid fifteen (15) minute coffee break in the morning of an employee's regular shift, at a time designated by supervision, and at reasonable intervals thereafter during overtime work.
Temporary Shutdowns. The Company reserves the right to require you to take annual leave during shut-down periods such as Easter & Christmas but only to the extent of your accrued annual leave. Where an Employee has insufficient annual leave, RDO’s or Long service leave may be taken. Where an Employee has insufficient annual leave entitlement, he/she may request to take up to five (5) days leave in advance, subject to the approval of the Company but only after RDO, AL and LSL entitlements are exhausted. At least four (4) weeks notice of a temporary shutdown will be provided.
