(a) The building and improvements to be constructed on the Adjacent Lot will be limited to those shown on the plan attached hereto as Exhibit D ("Starbucks Plan"). In no event will modifications to the Starbucks Plan be permitted without first obtaining Tenant's approval. The work related to construction of the Starbucks building and related common area alterations ("Starbucks Work") will be performed in a way that minimizes interference with ▇▇▇▇▇▇'s business from the Premises, including access to the Premises for Tenant's customers. The staging area for the Starbucks Work will be located on the Adjacent Lot in the location shown on the Starbucks Plan.
(b) After completion of the Starbucks Work, ▇▇▇▇▇▇▇▇ agrees to take appropriate steps, including additional signage, to ensure that the operation of the Starbucks drive through does not adversely impact access into and through the Land.
(c) Landlord hereby consents to the following (collectively, the "Curbside Pickup Work") by Tenant materially as shown on the attached Exhibit E, and adjustments to the same as reasonably necessary to comply with local requirements and/or to be consistent with changes to Tenant's Curbside Pickup program ("Curbside Pickup"), subject to the provisions of this Paragraph 2(b):
(i) designation of up to ten (I 0) parking stalls for Curbside Pickup (notwithstanding that Exhibit E shows only 4 stalls) with up to ten (I 0) pole signs mounted on a concrete base to be located near the main entrance to the Premises (but not to adversely impact handicapped parking spaces); and
(ii) penetrations on the front facade of the Premises below the roof line, for installation and operation of one ( l) camera and one (I) telecommunications access point with equipment as depicted on Exhibit E. Tenant, at its sole cost and expense, shall perform the Curbside Pickup Work in accordance with all applicable obligations under the Lease, including compliance with applicable Laws and obtaining any permits or authorizations required by the applicable governmental authority ("Permits"). Tenant Conditions. This Offer shall be conditional for five (5) days following acceptance of this Offer upon the Tenant reviewing and approving the terms of this Offer. This condition is for the sole benefit of the Tenant and the Tenant may approve this condition, in its sole and unfettered discretion, by giving notice in writing to the Landlord, or its agent, at any time prior to the expiration of the above mentioned five (5) days, failing which, this Offer shall be null and void.
Tenant Conditions. The Landlord acknowledges, covenants and agrees that this Lease is conditional upon the approval of the Tenant’s Board of Trustees within thirty (30) days of mutual execution of this Lease.
